Rewind to January 11th

NYSBA has received hundreds of complaints in recent months about Mr. Giuliani and his baseless efforts on behalf of President Trump to cast doubt on the veracity of the 2020 presidential election and, after the votes were cast, to overturn its legitimate results. As widely reported, these efforts included the commencement and prosecution of court actions in multiple states without any evidentiary basis whatsoever. In each and every instance, these actions were appropriately dismissed by the courts in which they were brought.

As the nation’s largest voluntary state bar association, NYSBA has a responsibility to defend and protect the rule of law. Based on these complaints, and the statement Mr. Giuliani uttered shortly before the attack on the Capitol, NYSBA President Scott M. Karson has launched an inquiry pursuant to the Association’s bylaws to determine whether Mr. Giuliani should be removed from the membership rolls of the Association.

A group of attorneys, including former federal prosecutors and retired partners at major law firms, are asking a state disciplinary panel to immediately suspend Rudy Giuliani’s law license pending an investigation into the former New York City mayor’s thwarted effort to overturn the results of the 2020 presidential election in favor of former President Donald Trump.

In a 21-page ethics complaint to a state attorney grievance panel, the nonpartisan organization Lawyers Defending American Democracy alleged that Giuliani “violated multiple provisions of the New York Rules of Professional Conduct” while representing Trump and the Trump campaign.

The filing did not call for a specific remedy, but said that Giuliani’s “flagrant and persistent lying” warranted heightened scrutiny and sanctions because it sought to undermine Americans’ constitutional right to vote.

Today:

A New York appellate court suspended Rudolph W. Giuliani’s law license on Thursday after a disciplinary panel found that he made “demonstrably false and misleading” statements about the 2020 election as Donald J. Trump’s personal lawyer.

The court wrote in a 33-page decision that Mr. Giuliani’s conduct threatened “the public interest and warrants interim suspension from the practice of law.”

Mr. Giuliani helped lead Mr. Trump’s legal challenge to the election results, arguing without merit that the vote had been rife with fraud and that voting machines had been rigged.

“We conclude that there is uncontroverted evidence that respondent communicated demonstrably false and misleading statements to courts, lawmakers and the public at large in his capacity as lawyer for former President Donald J. Trump and the Trump campaign in connection with Trump’s failed effort at re-election in 2020,” the decision read.

That’s gonna leave a mark. Will he be disbarred/ Stay tuned.
